Terms of Service
Version 1.1 — effective September 8, 2026
1. Agreement to terms
Devine ("Devine," "we," "us," or "our") operates the Devine website, mobile applications, and related services (together, the "Service"). By creating an account, subscribing to a creator, publishing content, or otherwise using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you and the organization.
2. What Devine is
Devine is a two-sided platform where creators publish recipes, articles, and cookbooks and build a subscriber base, and readers follow creators, subscribe to paid tiers, and cook from a personalized feed. Some content is free; some is available only to paying subscribers or as a one-time purchase.
3. Accounts
You must be at least 16 years old to create an account. You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your credentials confidential and tell us promptly at support@devine.app if you suspect unauthorized use.
4. Creator content
Creators retain ownership of the recipes, photos, articles, and other content ("Creator Content") they publish. By publishing on Devine, a creator grants us a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and format that content in order to operate and promote the Service (including to subscribers, in search results, and in previews).
Creators are solely responsible for their content, including that they have the rights to publish it and that it doesn't infringe anyone else's rights. We may remove content or suspend accounts that violate these Terms, infringe intellectual property rights, or violate applicable law.
5. Subscriptions, purchases, and billing
On the web, reader subscriptions and one-time purchases are processed by Stripe through Stripe Checkout. We never see or store your full card number. Paid subscriptions renew automatically at the price and interval shown at checkout until you cancel. You can cancel anytime from your account settings; cancellation takes effect at the end of the current billing period, and we don't provide prorated refunds for partial periods except where required by law or stated otherwise at purchase.
On mobile, reader subscriptions are purchased through Apple's App Store or Google Play in-app purchase systems. Those purchases are billed, renewed, and refunded according to Apple's and Google's respective terms and policies, not this section — manage or cancel an App Store/Play Store subscription through the corresponding store account settings.
Taxes. Prices displayed on the Service are in US dollars and are quoted exclusive of sales tax, VAT, GST, and similar transaction taxes. Where such a tax applies to a purchase made on the web, it is calculated at checkout and charged in addition to the displayed price, and appears on your receipt. Purchases made through the App Store or Google Play are sold to you by Apple or Google, whose storefront price for your country may already include local tax — so the amount charged there can differ from the price shown on our website. Your receipt, or the store's, is the record of what you were actually charged.
A subscription purchased on any platform unlocks the same access across web and mobile. We reserve the right to change subscription prices with advance notice; changes apply to future billing cycles, not to periods you've already paid for.
6. Creator payouts
Creators who sell subscriptions or paid content onboard to Stripe Connect and receive payouts through it, net of Stripe's and Devine's fees, subject to Stripe's Connected Account Agreement. Revenue owed to creators from mobile in-app-purchase sales is reconciled separately and paid out periodically over the same Stripe Connect account, since Apple and Google collect that revenue directly. Payout timing and fee amounts are described in your creator dashboard.
Taxes. Payouts are otherwise made gross: we do not withhold or deduct tax from them. You are solely responsible for determining, reporting, and paying any tax you owe on what you earn through the Service — including income tax and any sales tax, VAT, GST, or similar tax due on what you sell — and for any registration those obligations require. Where a tax form is issued for the payments you receive, it is issued by the payment processor for your connected account rather than by Devine; for US creators that is the Form 1099-K generated from your Stripe account. On in-app-purchase sales, Apple or Google may deduct local tax before their commission, and the amounts credited to you reflect that deduction. Nothing on the Service is tax or legal advice.
Estimates. Fee schedules, price limits, and any earnings figures illustrated on our marketing pages or in creator tools are estimates based on the rates in force at the time, before tax, and are not a guarantee of earnings. The per-sale record in your creator dashboard is what governs a specific sale.
7. Acceptable use
You agree not to:
- Publish content that is unlawful, infringing, or that you don't have the rights to post
- Harass, impersonate, or abuse other users or creators
- Circumvent paywalls, scrape the Service at scale, or attempt to access another user's account or paid content without authorization
- Use the Service to send spam or malware, or to reverse-engineer or disrupt it
- Use the Service in violation of applicable law
We may suspend or terminate accounts that violate this section, with or without notice, depending on severity.
8. Recipe and health disclaimer
Recipes, nutrition estimates, and cooking guidance on Devine are provided by creators or generated by automated tools and are for general informational purposes only — they are not medical, dietary, or allergen advice. Ingredient lists and nutrition figures may be incomplete or inaccurate. If you have food allergies, intolerances, or a medical condition affected by diet, verify ingredients yourself and consult a qualified professional before relying on any recipe. You use recipes and cook at your own risk.
9. Disclaimers and limitation of liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, Devine and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
10. Indemnification
You agree to indemnify and hold Devine harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access for violating these Terms, non-payment, or to comply with law. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification) will survive.
12. Changes to these Terms
We may update these Terms from time to time. For material changes, we'll notify you by email or in-app notice before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where local consumer-protection law requires otherwise.
